ENLIVEN MEMBERSHIP CONTRACT TERMS & CONDITIONS

  • PARTIES – This agreement is made between Enliven Coaching Australia Pty Ltd ABN 29 604 141 193 and the member whose name appears in the application for membership contract. The member’s name that appears in the application acknowledges that they are over the age of 18. Any members under the age of 18 must have a parent or guardian over the age of 18 sign for them. 
  • START DATE – You understand that your membership starts on the purchase day of your agreement.
  • PAYMENT AND FEES – All membership fees will be recovered from your nominated credit / debit account. Any bank fees charged to you because of a rejection when collecting your due membership fees will be charged directly to you by stripe or GoCardless. If a membership fees remains outstanding, you agree that, unless we are in breach of our obligations under the contract, these companies may continue to debit the nominated credit / debit account for the total amount due without notice to you. These companies will debit three times after failed transaction automatically. If debits continue to decline you will not be able to book into any classes at Enliven until funds are paid in full. You agree that Enliven Coaching can continue to debit your bank account or credit card for outstanding funds.

  • OUTSTANDING PAYMENTS – As a result of outstanding debts Enliven Coaching reserve the rights to refer overdue amounts to an external collections agency. In an event of payment defaults you will be liable to Enliven Coaching for all outstanding monies due and will be liable to pay Enliven Coaching debt recovery processes and legal costs. 

  • REFUNDS – In this contract all monies are non refundable. 

  • SUSPENSION OF CONTRACT/HOLIDAYS – You can suspend your membership for holidays. You will need to provide a written email 14 days before leaving for holiday stating the dates you will be away and when you will be back. Email [email protected] and provide a start and end date for suspension period.
  • SUSPENSION OF CONTRACT/SICKNESS – Enliven coaching does NOT pause contracts for illness or sickness. 
  • CHANGE OF DETAILS – You must notify us of any changes of address, phone contact numbers, email address, bank account and credit card details for payment and any other personal information that is relevant to your membership with us. Or update these details within your Glofox app.
  • PRIVACY STATEMENT AND ACKNOWLEDGEMENT – During the process of entering the contract with you and during the term of the contract we will obtain access to certain types of personal information, such as information relating to your health and financial position. All of this information is kept completely private between you and Enliven Coaching. 
  • MEMBERSHIP TERMINATION – Please provide 2 weeks notice for membership termination. Email [email protected] this will be processed by our admin team via the first email of termination. We do not accept verbal termination or termination through social media platforms. 
  • PUSH NOTIFICATIONS AND EMAILS – All members will be opted in to receive push notifications and emails. Enliven will communicate important information and updates through these avenues.
